Premise Expansion & Condition Modification

Premise Expansion

You can apply for a premise expansion if you are looking to expand the existing license premises such as adding an adjoining suite or serving alcohol on the patio. The newly acquired premise should be contigious to the existing licensed premise to qualify for a premise expansion request with ABC. This may need additional permits with the city, county and/or local governing bodies. Once the application is submitted to ABC, an inspection is performed by an ABC inspector. If there are any new residents falling within 100 feet of the newly acquired premise, ABC will notify these new residents. The whole process will take 60 to 90 days for approval.

Condition Modification

Based on certain criteria, ABC may impose certain conditions on your licensed premise. Below are certain examples.

  • A licensed premised may be allowed to sell only between 8 AM to 9 PM.
  • A licensed premise is not allowed to sell single cans of beer. You can request a modification or removal of part or all of their conditions, if the conditions have been in place for at least a year.

You must provide a detailed letter specifying the conditions that you are requesting to modify/remove along with the condition modification application, a signed copy of all the existing conditions. There is an ABC application fee of $560 (non-refundable) for this process.

Begin by meeting with the clients to understand their requirements and intentions regarding the proposed changes to their premises for premise expansion and conditions for condition modification.

Once all the information is received, we will complete all the required ABC forms and prepare the ABC packet for client signatures

We will reach out to law enforcement agencies and other relevant governing bodies to inquire if they have any objections to the proposed modification or removal of conditions (only for condition modification).

Once all the necessary documentation is gathered, we will compile the application packet, conduct thorough review and ensure that all required forms, fees, supporting documents are included and then submit it to Dept. of Alcoholic Beverage Control District Office

We will regularly follow up with the assigned Licensing Representative and providing any further information requested and keep you posted until the process is complete.
